El presente artículo de reflexión es el resultado de una investigación que tuvo un enfoque metodológico cualitativo que se expresó en dos dimensiones: uno analítico-conceptual y otro crítico-hermenéutico, y está dirigido primordialmente a examinar el problema de la obediencia moral al derecho desde los presupuestos teóricos y conceptuales de la ética normativa. Sosteniendo como tesis principal que la ética no puede equipararse a una moral aplicada, en la medida que esto implicaría confundir la ética con la moral y por el (...) contrario, el cumplimiento de las normas se da por ser lo moralmente correcto, en consecuencia, será posible concluir a través del presente trabajo que existe una obligación moral de cumplir el derecho, salvo juicios morales concretos frente a ciertas regulaciones de conductas establecidas por normas que no estén acorde a los valores críticos o morales. La intuición no es tratada por la etología, lo cual la excluye de los animales no humanos, sin embargo, psicólogos, neurólogos y filósofos reconocen que la intuición, del latín intueri «mirar hacia dentro», es percibir y decidir instantáneamente, sin la participación de la razón, y con la intervención de la parte más primitiva del sistema nervioso central de los animales humanos. La fenomenología apela a la experiencia intuitiva como fundamento del estudio de la realidad, manifiesta al ser, tal como es. (...) La intuición se asocia con experiencias previas, y de acuerdo al controversial misticismo cuántico: incluso con el futuro. Pero no se puede explicar con claridad racional, sino con expresiones emotivas, de por qué, luego de procesar tal información, se llega a tal conclusión, decisión o creación. La intuición es un fenómeno de animales humanos, y de animales no humanos, y más que eso. Es un fenómeno de las cosas vivas. Propongo, obviamente por intuición, su reconocimiento en un dialogo de saberes donde se ejercite más ésta y menos la razón. (shrink)

This work is an effort to philosophize about the scientific words we must use to describe behaviors. It was written as an essay thus it is left here for further development; the issue before us is an ethological one, it addresses the question: which words are the most convenient to use in rigorous behavioral studies in order to produce scientific knowledge? We discuss the historical and philosophical roots of this behavioral-scientific problem. We admit anthropomorphic inference of organisms’ behaviors, as a (...) mean to create scientific-novel knowledge. The dorsal and medial pallial formations of mammals, birds, and reptiles show overall functional striking similarities. Most of these similarities have been frequently considered examples of convergent evolution. However, a considerable amount of neurobiological comparative evidence suggests the presence of a common basic pattern of vertebrate forebrain organization. This common pattern can support functional conservation.

Sensory ecology is a discipline that focuses on how living creatures use information to survive, but not to live. By trans-defining the orthodox concept of sensory ecology, a serious heterodox question arises: how do organisms use their senses to live, i.e. to enjoy or suffer life? To respond to such a query the objective and emotional meaning of symbols must be revealed. Our program is distinct from both the neo-Darwinian and the classical ecological perspective because it does not focus on (...) survival values of phenotypes and their functions, but asks for the aesthetic effect of biological structures and their symbolism. Our message recognizes that sensing apart from having a survival value also has a beauty value. Thus, we offer a provoking and inspiring new view on the sensory relations of ‘living things’ and their surroundings, where the innovating power of feelings have more weight than the privative power of reason. What we observe, through our usually limited lens, is that differential growing of space determines forms -characterized by their shape, size and coloration. As non-Euclidean geometrical mathematics have proclaimed: forms are manifestations of the curvature of space. Physics and other natural laws impose mathematical structural restrictions to biological forms. The molecules comprising any living form become arranged in specific ways in response to physical forces as well as chemical and biochemical conditions. Over time, such forms inherit additional historical restrictions that (...) make up their meaning, their semiotics. Color does not escape from this orthogenic reality. In this study, we present the colored pattern of the connexivum of Triatoma maculata, an insect vector of the etiologic agent of Chagas disease. This model is used as an example to appreciate mimicry under a heterodox and provocative approach. We unveil that beyond 1) mathematical and 2) historical semiotic restrictions of T. maculata mimesis of a yellowish-black alternating pattern, there are also 3) artistic interpretations; where metaphysics of life, beyond human perspective, is included. Monetary intelligence theory asserts that individuals apply their money attitude to frame critical concerns in the context and strategically select certain options to achieve financial goals and ultimate happiness. This study explores the dark side of monetary Intelligence and behavioral economics—dishonesty. Dishonesty, a risky prospect, involves cost–benefit analysis of self-interest. We frame good or bad barrels in the environmental context as a proxy of high or low probability of getting caught for dishonesty, respectively. We theorize: The magnitude and intensity of (...) the relationship between love of money and dishonest prospect may reveal how individuals frame dishonesty in the context of two levels of subjective norm—perceived corporate ethical values at the micro-level and Corruption Perceptions Index at the macro-level, collected from multiple sources. Based on 6382 managers in 31 geopolitical entities across six continents, our cross-level three-way interaction effect illustrates: As expected, managers in good barrels, mixed barrels, and bad barrels display low, medium, and high magnitude of dishonesty, respectively. With high CEV, the intensity is the same across cultures. With low CEV, the intensity of dishonesty is the highest in high CPI entities —the Enron Effect, but the lowest in low CPI entities. CPI has a strong impact on the magnitude of dishonesty, whereas CEV has a strong impact on the intensity of dishonesty. We demonstrate dishonesty in light of monetary values and two frames of social norm, revealing critical implications to the field of behavioral economics and business ethics. (shrink)

Monetary Intelligence theory asserts that individuals apply their money attitude to frame critical concerns in the context and strategically select certain options to achieve financial goals and ultimate happiness. This study explores the bright side of Monetary Intelligence and behavioral economics, frames money attitude in the context of pay and life satisfaction, and controls money at the macro-level and micro-level. We theorize: Managers with low love of money motive but high stewardship behavior will have high subjective well-being: pay satisfaction and (...) quality of life. Data collected from 6586 managers in 32 cultures across six continents support our theory. Interestingly, GDP per capita is related to life satisfaction, but not to pay satisfaction. Individual income is related to both life and pay satisfaction. Neither GDP nor income is related to Happiness. Our theoretical model across three GDP groups offers new discoveries: In high GDP entities, “high income” not only reduces aspirations—“Rich, Motivator, and Power,” but also promotes stewardship behavior—“Budget, Give/Donate, and Contribute” and appreciation of “Achievement.” After controlling income, we demonstrate the bright side of Monetary Intelligence: Low love of money motive but high stewardship behavior define Monetary Intelligence. “Good apples enjoy good quality of life in good barrels.” This notion adds another explanation to managers’ low magnitude of dishonesty in entities with high Corruption Perceptions Index. In low GDP entities, high income is related to poor Budgeting skills and escalated Happiness. These managers experience equal satisfaction with pay and life. We add a new vocabulary to the conversation of monetary intelligence, income, GDP, happiness, subjective well-being, good and bad apples and barrels, corruption, and behavioral ethics. (shrink)

El Foro Global de Bioética en Investigación (GFBR por sus siglas en inglés) se reunió el 3 y 4 de noviembre en Buenos Aires, Argentina, con el objetivo de discutir la ética de la investigación con mujeres embarazadas. El GFBR es una plataforma mundial que congrega a actores clave con el objetivo de promover la investigación realizada de manera ética, fortalecer la ética de la investigación en salud, particularmente en países de ingresos bajos y medios, y promover colaboración entre países (...) del norte y del sur.a Los participantes en el GFBR provenientes de Latinoamérica incluyeron a eticistas, investigadores, miembros de comités de ética y representantes de autoridades sanitarias provenientes de Argentina, Brasil, Chile, Colombia, Ecuador, El Salvador, Guatemala, Honduras, Panamá, Perú, Nicaragua y la República Dominicana. Una legítima preocupación por la protección de las mujeres embarazadas y sus embriones o fetos ha llevado a la mayoría de los países de la Región de las Américas a limitar la realización de estudios con mujeres embarazadas exclusivamente a aquellos estudios específicos sobre el embarazo, y a requerir la exclusión sistemática de las mujeres embarazadas o de las mujeres que quedan embarazadas en el curso del estudio. Ciertamente, a lo largo de la historia de la ética de la investigación, se ha creído erróneamente que proteger a una población es sinónimo de excluirla de los estudios. Se sabe ahora que proceder así implica exponer a riesgos mucho mayores a la población que se busca proteger. El embarazo implica cambios fisiológicos sustantivos e impacta profundamente la manera como el cuerpo metaboliza los medicamentos. Sin embargo, por evitar hacer investigación con mujeres embarazadas, no se ha producido la evidencia científica necesaria para tomar decisiones sobre tratamientos e intervenciones preventivas con dosis eficaces y seguras para ellas y sus embriones o fetos. A manera de ilustración, en el 2001 había en los Estados Unidos apenas más de una docena de medicamentos aprobados para uso en el embarazo (1) y en el 2011 la Food and Drug Administration (FDA) aprobó por primera vez en 15 años un medicamento para su uso en el embarazo (2). Como consecuencia de no haber producido la evidencia necesaria, se pone en riesgo la salud de las mujeres embarazadas cada vez que se les da atención médica. Las mujeres embarazadas se enferman y las mujeres enfermas se embarazan, y no se sabe si los medicamentos que se les da son eficaces o siquiera seguros para ellas y sus embriones o fetos. (shrink)

Corruption involves greed, money, and risky decision-making. We explore the love of money, pay satisfaction, probability of risk, and dishonesty across cultures. Avaricious monetary aspiration breeds unethicality. Prospect theory frames decisions in the gains-losses domain and high-low probability. Pay dissatisfaction (in the losses domain) incites dishonesty in the name of justice at the individual level. The Corruption Perceptions Index, CPI, signals a high-low probability of getting caught for dishonesty at the country level. We theorize that decision-makers adopt avaricious love-of-money aspiration (...) as a lens and frame dishonesty in the gains-losses domain (pay satisfaction-dissatisfaction, Level 1) and high-low probability (CPI, Level 2) to maximize expected utility and ultimate serenity. We challenge the myth: Pay satisfaction mitigates dishonesty across nations consistently. Based on 6500 managers in 32 countries, our cross-level three-dimensional visualization offers the following discoveries. Under high aspiration conditions, pay dissatisfaction excites the highest- (third-highest) avaricious justice-seeking dishonesty in high (medium) CPI nations, supporting the certainty effect. However, pay satisfaction provokes the second-highest avaricious opportunity-seizing dishonesty in low CPI entities, sustaining the possibility effect—maximizing expected utility. Under low aspiration conditions, high pay satisfaction consistently leads to low dishonesty, demonstrating risk aversion—achieving ultimate serenity. We expand prospect theory from a micro and individual-level theory to a cross-level theory of monetary wisdom across 32 nations. We enhance the S-shaped Curve to three 3-D corruption surfaces across three levels of the global economic pyramid, providing novel insights into behavioral economics, business ethics, the environment, and responsibility. We introduce the work of Mariano Picón Salas, who tries to enlarge the Hispanoamerican tradition —historically focused on the web of transits/obstructions between Europe and Latin America— via a larger triangulation that includes the presence of the culture of the United States. His essays from the period 1930-1950 show how pragmatism —understood in Peircean terms as a web of topological transfers of knowledge between the borders of culture— can help to provide a vision that encompasses America as a whole.

Although eye tracking has been used extensively to assess cognitions for static stimuli, recent research suggests that the link between gaze and cognition may be more tenuous for dynamic stimuli such as videos. Part of the difficulty in convincingly linking gaze with cognition is that in dynamic stimuli, gaze position is strongly influenced by exogenous cues such as object motion. However, tests of the gaze‐cognition link in dynamic stimuli have been done on only a limited range of stimuli often characterized (...) by highly organized motion. Also, analyses of cognitive contrasts between participants have been mostly been limited to categorical contrasts among small numbers of participants that may have limited the power to observe more subtle influences. We, therefore, tested for cognitive influences on gaze for screen‐captured instructional videos, the contents of which participants were tested on. Between‐participant scanpath similarity predicted between‐participant similarity in responses on test questions, but with imperfect consistency across videos. We also observed that basic gaze parameters and measures of attention to centers of interest only inconsistently predicted learning, and that correlations between gaze and centers of interest defined by other‐participant gaze and cursor movement did not predict learning. It, therefore, appears that the search for eye movement indices of cognition during dynamic naturalistic stimuli may be fruitful, but we also agree that the tyranny of dynamic stimuli is real, and that links between eye movements and cognition are highly dependent on task and stimulus properties. Understanding how a nurse acts in a particular situation reveals how nurses enact their ethics in day-to-day nursing. Our ethical frameworks assist us when we experience serious ethical dilemmas. Yet how a nurse responds in situations of daily practice is contingent upon all the presenting cues that build the current moment. In this article, we look at how a home care nurse responds to the ethical opening that arises when the nurse enters a person’s home. We discuss how the home (...) presents the nurse with knowledge that informs the provision of ethical nursing care. The analysis is based on findings from an interpretive research study in palliative home care in Canada. Through interpretive analysis of a nursing situation we delineate how the nurse engages with the whole and acts inside the moment. The analysis shows how home care nurses are ethically determined to engage with whatever is going on in a patient’s home. (shrink)

Se propone un símil de dicha recepción en la teoría y estudios del arte, particularmente en México. A través de Metamorfosis. Hacia una teoría materialista del devenir y los conceptos clave como devenir-mujer y devenir-insecto, se entabla una relación con los feminismos visuales situados (...) en el sur global. El diálogo entre ambas recepciones, la filosófica y la artística, implica un acercamiento a la problematización y comprensión del conflicto capital-vida, además de las aportaciones posibles de la producción feminista, hace patente cómo se continúa en la teoría feminista actual una línea materialista, con profundas raíces clásicas, de una ontología del cuerpo. En las siguientes líneas se comparte una reflexión sobre la importancia, el sen- tido y la vigencia que tiene la bioética social en nuestros días. Si bien es cierto que con frecuencia el término bioética se relaciona con cuestiones de problemas y dilemas de ética clínica al interior de hospitales, así como con la defensa de los animales no humanos y el medio ambiente, la bioética tiene una cuña de intervención social con grupos de personas vulneradas en sus derechos o (...) que, por su condición, han sido socialmente invisibilizados. Por tal motivo, se pro- pone la inclusión de la bioética social como una herramienta de intervención educativa en sectores marginados o excluidos, y como mecanismo que permita el empoderamiento de las personas que pertenecen a estos grupos, a partir de los principios y nociones con los que trabaja la disciplina. O presente texto narra uma experiência de formação de alfabetizadores de jovens e adultos: uma alfabetização filosófica de 40 horas com 300 alfabetizadores em julho de 2022, como primeira etapa do Programa “Supera RN” em Pau dos Ferros, dentro da Política de Superação do Analfabetismo do Estado do Rio Grande do Norte (RN). O texto tematiza em que sentido a experiência de Alfabetização filosófica se inspira e ao mesmo tempo se diferencia do curso de Alfabetização oferecido por Paulo Freire em (...) Angicos em 1963. Inspirado na curiosidade e no compromisso de Paulo Freire com os esfarrapados do mundo, o conceito “alfabetização filosófica” propõe uma formação experiencial sustentada nas seguintes disposições: escutar atentamente o mundo humano e não humano que nos rodeia; pensar juntos com cuidado e calma; relacionarmo-nos cooperativa e não competitivamente com as ideias das outras pessoas; perguntarmo-nos, colocando em questão, nossa vida e a maneira como nos relacionamos com ela, num tempo especial, singular, suspendido; conversar como iguais na busca de enfrentar as exigências de nossa comunidade; inventar novas formas de estar com outras e outros. O texto apresenta como essas disposições foram pensadas e praticadas durante a alfabetização filosófica em Pau dos Ferros, RN, através de cinco princípios (perguntar; escutar; tempo de infância; igualdade; pensar juntos) e lança algumas perguntas sobre possíveis desdobramentos da alfabetização filosófica no campo de formação de professores. La narración común sobre la metafísica de Francisco Suárez entre un grupo diverso de pensadores es que el jesuita presenta una ontología «indiferente» que descuida la concepción medieval tradicional de Dios como absolutamente trascendente y única. Aunque las críticas dirigidas contra Suárez son legiones e igualmente diversas como las críticas de las que derivan, tal como yo lo entiendo, hay una convicción común a todas ellas, aunque no expresada, de que el pensamiento del jesuita finalmente resulta en la secularización de (...) la metafísica. Por «secularización» me refiero a que, como se afirma con frecuencia, el análisis de Suárez sobre la naturaleza del ser ocurre por completo sin la necesidad de advertir sobre ningún marco teológico general. En este ensayo, cuestiono ese punto de vista y sostengo que la metafísica de Suárez está completamente determinada por su visión teológica y su proyecto. (shrink)

Nos dedicaremos sobre todo al estudio del grado de reconocimiento del derecho al cambio de género en las leyes nacionales, así como si esas legislaciones res- petan o no el Convenio Europeo de (...) This paper is an evaluation of C. S. Peirce’s late essay “A Neglected Argument for the Reality of God”, based on the two logical values that he calls “productiveness” and “security.” After reviewing the unique logical form of “abduction” and noting that it is a formal fallacy—and so enjoys less “security” than deduction or induction—I turn to the extraordinary case of abduction that is found in “A Neglected Argument.” I argue that the productiveness of the Neglected Argument is found in (...) its ability to instigate practical results. The security of the Neglected Argument, on the other hand, is rooted in an activity Peirce calls “musement,” a kind of rational intuition. Moreover, I suggest that Peirce’s notion of “musement,” which has remained something of a mystery in Peirce studies, arose from hisearly reading of Friedrich von Schiller’s aesthetics. (shrink)

I argue for the possibility of the thesis that metaphors are indispensable for grasping and expressing certain propositions. I defend this possibility against the objection that, if metaphors express propositions, once these propositions are identified they should be specifiable by non‐metaphorical means. I argue that this objection loses its strength if one adopts a Wittgensteinian, particularist view of thought, according to which grasping a propositional thought requires the ongoing exercise of a suitable skill often not characterizable by algorithmic rules. Este artículo sitúa el marco fenomenológico-hermenéutico en torno al otro y desarrolla la hipótesis de que la cuestión de la intersubjetividad es central para entender las categorías fundamentales relativas a todo pensar acerca de la alteridad que se plantean en filosofía, en literatura y en los discursos sociopolíticos, ya que implican una cuestión central acerca de la analogía. Asumiendo la obra de E. Husserl, y en especial los comentarios contemporáneos sobre Phänomenologie der Intersubjektivität, se avanza en un enfoque interdisciplinario del (...) “otro” y del “alter ego” --propias de una analítica de la experiencia humana--, demostrando que la experiencia de la sociabilidad se forja a partir de vivencias originarias que refieren a un determinado modo de entender el vínculo analógico entre el yo y el otro y los otros. This article situates the phenomenological-hermeneutical framework around the other and develops the hypothesis that the issue of intersubjectivity is central in understanding the fundamental categories related to any thought regarding alterity which are proposed in philosophy, in literatura, and in socio-political discourse, since it implies a central questioning about the analogy. Assuming the work of E. Husserl, and especially the contemporary comments on Phänomenologie der Intersubjektivität,we advance toward an interdisciplinary focus of the “other” and the “alter ego” --proper to an analysis of the human experience--, demonstrating that the experience of sociability is forged from the original life experiences that refer to a determined way of understanding the analogic relationship between the self and the other and the others. The nonlinear differential equation governing the periodic motion of the one-dimensional, undamped, and unforced cubic-quintic Duffing oscillator is solved exactly by obtaining the period and the solution. The period is given in terms of the complete elliptic integral of the first kind and the solution involves Jacobian elliptic functions. We solve the cubic-quintic Duffing equation under arbitrary initial conditions. Physical applications are provided. The solution to the mixed parity Duffing oscillator is also formally derived. In this paper I discuss Albert the Great’s notion of univocal analogy, which he raised in his Commentary on Pseudo-Dionysius’s De divinis nominibus. While other scholars such as Francis Ruello and Alain de Libera have addressed “analogy” as it pertains to Albert, I intend to treat the “univocal” aspect of “univocal analogy” so as to explain (1) how it informs Albert’s teaching on analogy, and (2) how it remains opposed to any pantheistic reduction of God to creature. While my own (...) account remains close to that of Ruello and De Libera, I hope to show how primacy is to be accorded to univocity in such a manner that, in actual reality, for Albert, it is analogy that qualifies univocity rather than vice versa. This article explores Bonaventure’s metaphysical account of creation, which holds that at the heart of every creature is a sort of metaphysical vanity. That vanity stems from the exigencies of a creation metaphysics in which the creator-God draws every creature out of nothingness into being. But, while God’s creative act sustains the creature in being, the nothingness from which God preserves creation, on Bonaventure’s view, always remains a feature of creation’s metaphysical constitution. In short, for the Seraphic Doctor, because nothingness (...) always resides in creation, creation itself is fundamentally vain. Since vanity is a central theme in the book of Ecclesiastes, concerning which Bonaventure has left us a commentary, I argue that the metaphysical vision he employs to illuminate the nature of vanity as it pertains to creation—both within his biblical commentary and beyond—can be properly described as a “metaphysic of Ecclesiastes.”. In this paper I argue that defeasible inferences are occasion-sensitive: the inferential connections of a given claim depend on features of the circumstances surrounding the occasion of inference. More specifically, it is an occasion-sensitive matter which possible defeaters have to be considered explicitly by the premises of an inference and which possible defeaters may remain unconsidered, without making the inference enthymematic. As a result, a largely unexplored form of occasion-sensitivity arises in inferentialist theories of content that appeal to defeasible inferences.

This paper discusses practical akrasia from the perspective of the sophisticated form of moral subjectivism that can be derived from Nuno Venturinha’s (2018) remarks on moral matters.

Organ transplantation is a lifesaving procedure for end-organ damage and remains up to today as the most cost-effective alternative to treat these conditions. However, the main limitation to performing organ transplants is the availability of donor organs suitable for transplantation. To increase the donor pool, expanding organ donation from the conventional neurologic determination of death (NDD) to include circulatory determination of death (DCD) has been a well-established method of increasing donors in other countries. In this article, we discuss the clinical (...) and ethical considerations for introducing DCD in Chile. The concepts we have used could very well be translatable to other similar countries which have not implemented this donation system yet. The most relevant issue to date is that DCD needs to alter the care of dying patients to obtain quality donor organs. In some countries, including Chile, there are some cultural barriers regarding withdrawal-of-care. These barriers include confusing withdrawal of care with acceleration of death, which leads to many practitioners refusing to remove artificial life support, and in turn only minimize ventilatory support or switch to a T-tube (without extubation). This cultural barrier could be overcome with careful consideration of the opinions of healthcare workers, family members, community and policy-based stakeholders. We also identified ethical issues related to informed consent of both donor and recipients, among other relevant ethical considerations. In conclusion, DCD donation in Chile can increase organ donation numbers in one of Latin America's countries with the lowest effective donor rate. However, this opportunity must be taken with caution to avoid the opposite effect if this policy is not well implemented, respecting the sound ethical principles mentioned in this paper. (shrink)

O presente texto narra uma experiência de formação de alfabetizadores de jovens e adultos: uma alfabetização filosófica de 40 horas com 300 alfabetizadores em julho de 2022, como primeira etapa do Programa “Supera RN” em Pau dos Ferros, dentro da Política de Superação do Analfabetismo do Estado do Rio Grande do Norte (RN). O texto tematiza em que sentido a experiência de Alfabetização filosófica se inspira e ao mesmo tempo se diferencia do curso de Alfabetização oferecido por Paulo Freire em (...) Angicos em 1963. Inspirado na curiosidade e no compromisso de Paulo Freire com os esfarrapados do mundo, o conceito “alfabetização filosófica” propõe uma formação experiencial sustentada nas seguintes disposições: escutar atentamente o mundo humano e não humano que nos rodeia; pensar juntos com cuidado e calma; relacionarmo-nos cooperativa e não competitivamente com as ideias das outras pessoas; perguntarmo-nos, colocando em questão, nossa vida e a maneira como nos relacionamos com ela, num tempo especial, singular, suspendido; conversar como iguais na busca de enfrentar as exigências de nossa comunidade; inventar novas formas de estar com outras e outros. O texto apresenta como essas disposições foram pensadas e praticadas durante a alfabetização filosófica em Pau dos Ferros, RN, através de cinco princípios (perguntar; escutar; tempo de infância; igualdade; pensar juntos) e lança algumas perguntas sobre possíveis desdobramentos da alfabetização filosófica no campo de formação de professores. This target article considers the ethical implications of providing prenatal diagnosis (PND) and antenatal screening services to detect fetal abnormalities in jurisdictions that prohibit abortion for these conditions. This unusual health policy context is common in the Latin American region. Congenital conditions are often untreated or under-treated in developing countries due to limited health resources, leading many women/couples to prefer termination of affected pregnancies. Three potential harms derive from the provision of PND in the absence of legal and safe abortion (...) for these conditions: psychological distress, unjust distribution of burdens between socio-economic classes, and financial burdens for families and society. We present Iran as a comparative case study where recognition of these ethical issues has led to the liberalization of abortion laws for fetuses with thalassemia. We argue that physicians, geneticists and policymakers have an ethical and professional duty of care to advocate for change in order to ameliorate these harms. (shrink)

A dilemma has stymied interpretations of the Stranger’s method of dividing kinds into subkinds in Plato’sSophistandStatesman. The dilemma assumes that the kinds are either extensions or intensions. Now kinds divide like extensions, not intensions. But extensions cannot explain the distinct identities of kinds that possess the very same members. We propose understanding a kind as like an animal body—the Stranger’s simile for division—possessing both an extension and an intension. Abstract The article addresses three aspects of the humanitarian intervention doctrine. It argues, first, that the value of sovereignty rests on the justified social processes of the target state ? the horizontal contract. Foreign interventions, even when otherwise justified, must respect the horizontal contract. In contrast, morally objectionable social processes (such as the subjection of women) are not protected by sovereignty (intervention, of course, may be banned for other reasons). In addition, tyrants have no moral protection against interventions directed at (...) them. Second, the article addresses the internal legitimacy of humanitarian intervention. It concludes that the liberal state may only use voluntary soldiers (either the voluntary army or mercenaries) to conduct humanitarian intervention. Conscription for that purpose is not permissible. The article shows that the long-standing criticism of mercenaries stems from a romantic prejudice and is thus unfair. Third, the article makes a distinction between intention (the determination to perform an action) and motive (a further goal that the agent seeks with that action) and shows that only intention is relevant for humanitarian intervention. A justified humanitarian intervention requires the intention to liberate the victims, but not necessarily a good further motive. It shows how mainstream doctrine has impermissibly confused the two concepts. (shrink)

Cuando enfrentan un escándalo, las empresas deben entablar una comunicación efectiva para intentar aminorar los efectos de la publicidad negativa sobre su imagen corporativa. Uno de los géneros empleados por las empresas como formas de discurso de reparación de la imagen es la declaración pública, que corresponde a un texto escrito corto emitido por una empresa con el propósito de comunicar su versión de la crisis que enfrenta directamente al público general, publicándola en el sitio web de la compañía, o (...) bien pagando una inserción en un periódico. El presente estudio, un estudio de casos múltiples, se propone determinar si la retórica empleada por las empresas chilenas cuando enfrentan un escándalo mediático, es decir, la forma en que argumentan y se defienden de las acusaciones de mala conducta, es ética y lícita desde la perspectiva de la ética empresarial. Para ello, se realizó un análisis crítico del manejo de la carga de la prueba en un corpus de veintiséis declaraciones públicas emitidas por empresas chilenas tras una crisis que empañó su imagen corporativa. Basándonos en la regla de la carga de la prueba propuesta desde la teoría pragma-dialéctica, y en algunos lineamientos para el diseño de códigos de ética corporativos planteados en la literatura se pudo determinar la validez de la argumentación retórica desplegada por las empresas. Los resultados muestran que la mayoría de las empresas evaden la carga de la prueba, lo que sugiere que estas empresas chilenas no se sienten obligadas a dar cuenta de sus acciones. El análisis ético revela que en la vasta mayoría de estas declaraciones no se emplea una retórica que evidencie un respeto hacia los afectados por la actividad de la empresa, especialmente hacia los consumidores, los trabajadores de la empresa y los competidores. Una de las conclusiones del estudio es que las empresas chilenas evidencian una concepción bastante limitada de lo que es la ética empresarial, que no considera los conceptos de transparencia ni responsabilidad pública y de control. The following essay considers Luis de Losada’s thinking with respect to the scholastic dispute between univocity and analogy. Noteworthy is the fact that the conclusions he reaches are at odds with those of Francisco Suarez, whom the younger Jesuit otherwise regards with unmitigated filial devotion. Though Losada differs from his master regarding analogy, the position he puts forth capitalizes upon a distinction between a logico-semantic perspective and a metaphysical perspective. The result is an irenic balance among all the schools (Thomistic, (...) Scotist, and Jesuit) regarding univocity and analogy. Nevertheless, Losada goes beyond the discussions dividing proponents of analogy and those of univocity when he inquires whether any kind of analogical community obtains between real being and beings of reason. Remarkably, he answers that there is a univocal community, thereby embracing the scholastic notion of supertranscendentality. (shrink)
